LEAP Terms of Use
Who We Are
We are School Choice International Inc., a New York corporation. We created LEAP as a free service for schools and parents. There is no charge for the service. But by using this service, you agree to be bound by these Terms of Use.
What is LEAP?
The LEAP questionnaire, or “LEAP”, is an online tool that aims to match the values and principles of parents searching for the right place for their children with those of independent schools in New York City. It’s a personalized, thought-provoking analytical tool to aid in your school search.
LEAP is an acronym for Learning, Ethos, Achievement, and Principles. The LEAP questionnaire is organized into these four categories. LEAP offers parents a unique perspective that considers elements of school culture beyond the facts and figures that can be easily found online. It offers schools the opportunity to highlight what makes them stand out amongst their peers.
After you register at the LEAP website, you may visit the site, sign in with your user name and password, and answer the on-screen questions. These questions are similar to those that independent schools in New York City have answered. Based on your answers, LEAP will find and display for you at least five (and possibly more) schools that closely match your input and that you should add to the list of schools you’re considering for your child.
Permitted Uses
LEAP is intended to be used by schools and parents of school-age children (“you”). You may use LEAP only for your immediate family for the purposes described above under the heading “What is LEAP?”.
Use of LEAP is with our permission. We may revoke our permission at any time, for any reason, in our sole discretion.
Prohibited Uses
The LEAP service and website may not be used for the purpose of:
- performing services or collecting information about the schools we list for any entity or for anyone who is not a member of your immediate family or for any commercial purpose,
- collecting usernames or email addresses of users for the purpose of sending unsolicited email or
- unauthorized framing of or linking.
Disclaimers
Although we endeavor to provide accurate and current questionnaire responses from participating schools and to accurately correspond your questionnaire responses with those of the schools, you acknowledge that the results LEAP delivers to you may contain errors, inaccuracies or outdated information, and it may not include all relevant schools. We deliver LEAP and its services on an “as is” basis. We are not responsible for errors, inaccuracies or omissions in LEAP or the results LEAP delivers to you, nor for any consequence of your use of or reliance upon LEAP or such results in taking any action or deciding not to take any action. We recommend that you follow up by contacting us and seeking further information from us, from the schools themselves and from other sources.
No Warranties
We do not warrant the accuracy, completeness or usefulness of any information you receive from LEAP. To the maximum extent permitted by applicable law, we disclaim all warranties, either express, implied or otherwise with respect to LEAP and the information schools provide to us. LEAP does not warrant that access to or use of LEAP or this website will be uninterrupted or error-free or completely secure.
Limitation of Liability
To the maximum extent permitted by applicable law and regardless of whether any remedy in this Agreement fails of its essential purpose, in no event will we be liable for any special, incidental, indirect, consequential or punitive damages whatsoever arising out of these Terms of Use or your use of or inability to use LEAP, even if we have been advised of or should have known of the possibility of such damages.
Limitation of Actions
In no event may you bring an action against us more than one year after the cause of action occurs.
Your Indemnity
You agree to defend, indemnify and hold us and our officers, directors, employees, shareholders and assigns harmless from any claim, demand, liability, loss, damage, cost and expense (including reasonable attorneys’ fees) arising from or relating to: (i) your use of and access to the LEAP service or website; (ii) your breach of these Terms of Use; or (iii) your violation of any law.
We have the right to reject any settlement that might adversely affect us. We will give you timely written notice of any claim that may require indemnification. We reserve the right to participate in the defense, with counsel of our choice and at our own expense, of any action that may give rise to your obligation to indemnify.
Proprietary Rights
We own and retain all proprietary rights in LEAP, this website and the information you receive from your use of LEAP. You may not copy, modify, publish, transmit, distribute, perform, display, or sell any content or information from this website or any information you receive from your use without our prior written approval.
We are the sole owner of the School Choice International trademarks. These Terms of Use give you no right to use our trademarks.
Privacy
Your use of LEAP is governed by our Privacy Policy. [Link] Please do not use LEAP if you do not consent to this policy.
Notices
We may give notices to you by email, regular mail or overnight delivery service using the contact information you provide to us. You may notify us by any of the same methods at the address or email address indicated under the heading “Further Information” below.
Modifications
We reserve the right to modify these Terms of Use at any time by posting revised terms on this website. Your continued use of this website will be governed by the Terms of Use in force at the time of your use.
Governing Law
This Agreement is governed by the laws of the state of New York, USA, without regard to New York’s conflict of laws principles.
Jurisdiction
Any claim or dispute between you and us that arises in whole or in part from your use of LEAP or this website will be decided exclusively by a court of competent jurisdiction located in New York, NY, or in White Plains, NY, U.S.A. Each party consents to the exclusive jurisdiction of such courts in any such action or proceeding.
